Convictions Are Cumulative

Each conviction for domestic assault enhances future punishments. The levels of domestic assault charges are:

  • A first-time offense, or the first offense in 10 years, is a misdemeanor.
  • Having one prior domestic violence conviction in the past 10 years results in a gross misdemeanor.
  • Two or more domestic violence convictions in the past 10 years mean you are charged with felony domestic assault punishable by up to five years in prison and/or a $10,000 fine.
