Degrees Of Burglary

Conviction for burglary carries serious penalties in Minnesota. The charges vary in severity as follows:

  • First-degree burglary — It is entering when any type of dangerous weapon is used, the burglar assaults someone in the building and/or the structure is occupied when the burglar is present. If found guilty of first-degree burglary, you could be sentenced to up to 20 years in prison and pay a $35,000 fine.
  • Second-degree burglary — It is entering a building that is a home, financial institution or pharmacy, and entry is forced or the burglar uses a tool to gain access to money or property. A second-degree burglary charge carries a 10-year prison sentence and a fine of $20,000.
  • Third-degree burglary — It involves entering while another criminal act such as theft or another type of gross misdemeanor is committed. Conviction carries a sentence of up to five years in prison and a $10,000 fine.
  • Fourth-degree burglary — It involves entering and committing another act that is considered a misdemeanor. You face up to one year in prison and a $3,000 fine for conviction.
